Acceptance of Terms

By accessing or using PulseChk at pulsechk.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Stefan Heinz ("we," "us," or "our"), the operator of PulseChk.

Description of Service

PulseChk is a diagnostic assessment engine designed for coaches, consultants, agencies, and service professionals ("Providers"). The Service enables Providers to:

  • Create AI-powered diagnostic assessments tailored to their business and audience.
  • Embed assessments on their own websites or share them via direct links.
  • Collect responses from their website visitors ("Visitors") and generate multi-dimensional scores.
  • Deliver personalized result reports with AI-generated insights to Visitors.
  • Manage leads with score data, export capabilities, and webhook integrations.

Account Registration

Provider Accounts

To use PulseChk as a Provider, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security of your account credentials.
  • Promptly update your account information if it changes.
  • Accept responsibility for all activity that occurs under your account.
  • Maintain one account per individual. Shared accounts are not permitted.

We reserve the right to suspend or terminate accounts that violate these Terms.

Access Control

PulseChk may operate an access gate during early access or limited availability periods. Being on a waitlist does not guarantee access. We may grant or revoke access at our sole discretion.

Provider Responsibilities

As a Provider, you are responsible for:

  • Content accuracy: Ensuring that your assessment content, business information, and branding materials are accurate and not misleading.
  • Legal compliance: Complying with all applicable laws and regulations in your jurisdiction, including data protection laws governing the personal data you collect from your Visitors.
  • No prohibited content: Not using the Service to create assessments that contain illegal content, hate speech, harassment, or content that violates the rights of others.
  • No clinical claims: Not using the Service to provide medical diagnoses, clinical assessments, mental health screenings, or any content that could be construed as professional medical advice (see "Not a Medical Tool" section below).
  • Visitor communication: How you use the lead data collected through your assessments is your responsibility. You must comply with applicable laws regarding marketing communications to your leads.

Visitor Consent

When a Visitor takes an assessment:

  • The Visitor's data (name, email, responses, and scores) is shared with the Provider who created the assessment.
  • PulseChk acts as a data processor on behalf of the Provider. The Provider is the data controller for their Visitors' personal data.
  • PulseChk is not responsible for how a Provider uses Visitor data after it is collected. Visitors should review the Provider's own privacy policy for information about the Provider's data practices.
  • For Visitors in the EU/EEA, explicit GDPR consent is obtained before data collection.

AI-Generated Content Disclaimer

PulseChk uses artificial intelligence to generate assessment questions, scoring categories, personalized insights, and resource recommendations. You acknowledge that:

  • AI-generated content is provided as suggestions and starting points, not definitive professional advice.
  • AI-generated insights in result reports are based on pattern analysis of assessment responses and should not be treated as expert opinions.
  • Providers are responsible for reviewing and editing AI-generated assessment content before publishing.
  • PulseChk does not guarantee the accuracy, completeness, or suitability of any AI-generated content.
  • AI-generated content is not a substitute for professional consultation in any field, including but not limited to medicine, law, finance, or mental health.

Not a Medical Tool

PulseChk must NOT be used for clinical assessment, mental health screening, medical diagnosis, or any purpose that requires a licensed healthcare professional.

The Service is designed for business diagnostic assessments — evaluating readiness, identifying knowledge gaps, assessing fit for services, and similar non-clinical purposes. Assessments created on PulseChk are not validated psychometric instruments and should not be represented as such.

If you are a healthcare provider, therapist, or counselor, you may use PulseChk for general business intake purposes (e.g., "Is this service a good fit for you?") but not for clinical screening or diagnosis.

Data Ownership

  • Provider content: You retain ownership of all assessment content, branding materials, and business information you provide or create using the Service. By using the Service, you grant PulseChk a limited, non-exclusive license to process, store, and display this content as necessary to operate the Service.
  • Visitor data: Personal data collected from Visitors through your assessments belongs to your assessment data. You are responsible for its use in accordance with applicable laws. PulseChk retains a processing license to store and process Visitor data as needed to deliver the Service.
  • Platform data: Aggregated, anonymized usage statistics and analytics belong to PulseChk and may be used to improve the Service.

Intellectual Property

  • PulseChk platform: The Service, including its design, code, algorithms, scoring engine, AI integration, and brand identity, is the intellectual property of Stefan Heinz. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
  • Your content: You retain all rights to your original content. PulseChk does not claim ownership over assessments you create or the business information you provide.
  • Trademarks: "PulseChk" and associated logos are trademarks of Stefan Heinz. You may not use our trademarks without prior written permission, except as enabled by the "Powered by PulseChk" footer on embedded assessments.

Payment Terms

  • PulseChk operates on a subscription-based pricing model.
  • New accounts receive a 14-day free trial. No permanent free tier is available.
  • Payment terms, pricing, and billing details are provided at the time of subscription and on our pricing page.
  • Failure to pay may result in account suspension or downgrade.
  • Refunds are handled on a case-by-case basis. Contact support@pulsechk.app for billing inquiries.

Service Availability

  • We use reasonable efforts to maintain the availability of the Service, but do not guarantee uninterrupted access.
  • The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including but not limited to natural disasters, power outages, internet disruptions, third-party service failures, and government actions).
  • We are not liable for any loss or damage resulting from Service unavailability.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • PulseChk is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
  • We do not warrant that the Service will be error-free, secure, or uninterrupted.
  • In no event shall Stefan Heinz be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
  • Our total liability for any claim arising from or related to the Service shall not exceed the total fees you have paid to us in the twelve (12) months preceding the claim.
  • This limitation applies regardless of the legal theory under which damages are sought.

Account Termination

  • By you: You may terminate your account at any time through the account settings page. Upon termination, you may export your data during a grace period.
  • By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, fail to pay subscription fees, or for any other reason at our sole discretion with reasonable notice.
  • Effect of termination: Upon termination, your right to use the Service ceases immediately. Your data will be available for export during a grace period, after which it will be permanently deleted.
  • Survival: Sections regarding intellectual property, limitation of liability, governing law, and any obligations that by their nature should survive termination will remain in effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States of America, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the Service shall be resolved in the courts of the State of Colorado, and you consent to the personal jurisdiction of such courts.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

  • We will update the "Last updated" date at the top of this page.
  • We will notify Providers via email at least 14 days before significant changes take effect.
  • Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
  • If you do not agree with the revised Terms, you must stop using the Service and terminate your account.
